Bankruptcy can be a very powerful litigation tool but you need to make sure your lawyers know who to use it.

Result: Client was a self-employed contractor who has injured on the job and had to seek bankrutpcy protection.A creditor filed an advesary proceeding against our client trying to argue that he committed fraud and should not be allowed to discharge her debt. We took the case to trial and the case against our client was dismissed.

Result: Client kept her house and was able to discharge all of her credit card debt in the Chapter 13 bankruptcy.Client had to file bankruptcy to stop a foreclosure sale. We filed a Chapter 13 and were able to stop the foreclosure and save her home. She is currently paying her mortgage arrears through a Chapter 13 case but is not required to pay anything back to her unsecured creditors.

Result: We proved to the U.S. Trustee that these clients passed the 2nd half of the two-part Means Test and were eligible to file a Chapter 7.  – These client had a higher income than some Chapter 7 clients but their necessary expenses  allowed them to receive a discharge. Several attorneys these clients had met with tried to push them into a Chapter 13 case but we were able to respond to the UST and get our clients through the Chapter 7 case.

Result: Client got his car back, saved thousands in interest, and discharged his unsecured debts.Client’s vehicle was repossessed. We filed a Chapter 13 case. We were able to recover the vehicle and pay off the balance through a Chapter 13 case at a much lower interest rate. The client’s contract rate was 29.9% and we were able to cram the interest rate down to 5.5%.

Result: We filed Chapter 7 for them both personally and for their business. They discharged nearly one million dollars in business and personal debt and got a fresh financial start.This family owned a restaurant that had to close its doors. Although the business had some assets, the business owed over $1 million in debts. We filed a business Chapter 7 for the business in order to properly liquidate the assets for the business and then filed a personal Chapter 7 case for the huband and wife.

Result: Thanks to our knowledge of an obscure exception to the Means Test, these clients were able to discharge all of their unsecured debts in a quick and easy Chapter 7 case.These clients had a tremendous amount of credit card debt. However, because of their income they failed the first half of the two-part Means Test. Nevertheless, we proved that they qualified for an exception to the B22 income requirement due their non-consumer debt.

Result: Client got rid of the garnishment from her judgment and was able to reduce her monthly budget and discharge all of her unsecured debts.Client had a garnishment action against her from a judgment and a high interest vehicle note. Client filed a Chapter 13 bankruptcy to stop the garnishment and repay the vehicle note through a Chapter 13 bankruptcy at a lower interest rate and lower the monthly payments on her car.

Result: Client saved his house from going back to the bank and discharged his unsecured debts. Client was scheduled for foreclosure. We filed a Chapter 13 and stopped the foreclosure. Client is currently paying the mortgage arrears through a Chapter 13 bankruptcy case.

Result: Client was not only able to stop the I.R.S. from charging him post-petition penalties and interest, he was also able to discharge his older IRS debts and pay the recent ones back at 0%.Client had several years of IRS debt. He was able to repay the IRS debt through a Chapter 13 bankruptcy and stop all levy actions.

Result: We helped client file a Chapter 7 bankruptcy. Ultimately, all of her unsecured debts were discharged and we helped her recover thousands of dollars from the flooring company.Our elderly client was left with tens of thousands in unsecured debt after running up her credit card bills during a medical issue.

Result: We stopped our client from going to jail due to past due child support.Our client lost his job for a few months and fell behind on his child support.His ex took out a warrant for his arrear for violatinf the court order however we were able to file a Chapter 13 case and allow him to restructure his child support arrears through his bankruptcy case.
