What to Do If Your Bankruptcy Case Is Dismissed

  • If this case that was dismissed was your only case in the last 12 months then you can probably refile immediately
  • If it has been more than 180 days since you completed your pre-filing credit counseling course then you will need to redo it for your new case
  • You will need to provide the last 60 days of paystubs for your new case.
  • A new Chapter 13 Plan will need to be created for your new case.
  • File your new case and stop creditor collection actions.
  • A Motion to Extend Stay needs to be filed since this is your second case in the last 12 months

Don’t Wait Too Long After Your Case is Dismissed! Refile Your Bankruptcy and Protect Your Assets.

Remember that when your case is dismissed, your creditors receive notice as well. They can resume all collection, foreclosure, or repossession actions so you need to refile your case quickly.

What Documents Will I Need If I Decide to Re-File Bankruptcy Case?

The good news is that our firm can pull all of your prior case information from the court docket so you don’t need to provide us with any of your prior case information. Just review the list of documents that the court will require below.

If you re-filing a Chapter 13 case you will be required to provide the last 60 days of income statements again.  If you are unemployed, self-employed, or receive SSI you can sign an affidavit as to this in our office or online.

The court will require a copy of your last filed tax return. If you are not required to file taxes you can sign an affidavit as to this. If you have misplaced your copy we can request a transcript when you come into our office.

In order for your case to be valid upon filing you must complete a pre-filing credit counseling course.  The course you completed in your last case is good for 180 days so if your case was just dismissed you may be able to use that one.  Otherwise, you will need to redo the course. There are several different companies that provide this service.  The three companies that most of our clients use are:

  1. www.debtoredu.com
  2. www.abacuscc.org
  3. https://ccadvising.com

When you file for bankruptcy you are required to list ALL creditors and provide their last know mailing address. It is very important that you list everyone in order to receive your discharge. Our firm will pull credit reports and perform a nationwide lien search.
